PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING. BY SUBMITTING AN ENTRY, YOU AGREE TO BE BOUND BY THESE TERMS.

This giveaway is operated by Nine Dots Studio (the “Organizer”). It is not sponsored, endorsed, administered by, or associated with TikTok, YouTube (Google LLC), Instagram (Meta Platforms, Inc.), or Discord Inc. (collectively, the “Platforms”). Any questions or complaints should be directed to Nine Dots Studio, not to the Platforms.LEGAL NOTICE:

As part of the "Visit Aurai" contest (the "Contest"), Nine Dots Studio ("9Dots") will collect your personal information, including your name, email address, and photos and videos submitted publicly via YouTube, Instagram, TikTok, and Discord using the hashtag #exploreaurai. The information collected will only be used for the purpose of administering the Contest, and for advertising and communications related to the Contest and the game "Outward 2." Your personal information will not be shared with third parties. By submitting your images, photos, audio files, and videos as part of the Contest, you agree that 9Dots may use all or part of this audiovisual material for communication and promotional purposes on social media for 9Dots, the Contest, and Outward 2. You may at any time request the correction or removal of the information submitted, or withdraw your consent to the use of the information provided, by writing to info@ninedotsstudio.com. By posting photos, images, video or audio recordings on social media using the hashtag #exploreaurai, you agree that your submitted images, sounds, and videos may be publicly broadcast, subject to the terms and conditions of the aforementioned third-party platforms, you waive any rights over said images, sounds, and videos, and you agree that these images, sounds, and videos may be used in a reasonable manner in connection with the promotion of the Contest and the game Outward 2, without compensation from 9Dots, and you waive any recourse against the reasonable use of your images, sounds, and videos in the context described above. The Contest is limited to individuals aged 18 or older as of the Contest launch date (May 25, 2026). No purchase required. Prize value: approx. $60.

The winners of the Contest will be announced via Discord on June 30th 2026 at 3:00 PM EST.

1. DEFINITIONS

“Contest” means the “Visit Aurai Outward 2 Beta Community Giveaway” described herein.

“Entry” means any qualifying submission made in accordance with Section 4.

“Entry Period” means the period from 00:00 UTC on 26 May 2026 to 23:59 UTC on 22 June 2026.

“Organižer” means Nine Dots Studio, the developer and publisher of Outward 2.

“Participant” means any individual who submits a valid Entry.

“Platform” means, individually or collectively, TikTok, YouTube, Instagram, and Discord.

“Prize” means two (2) PC Steam keys for Outward 2, granting early access ahead of the game’s general release, as further described in Section 7.

“Winner” means a Participant selected pursuant to Section 8.

2. ELIGIBILITY

2.1 Age & Capacity

The Contest is open to individuals who are at least eighteen (18) years of age at the time of entry, or such higher minimum age as required by applicable law in their country of residence. In jurisdictions where the age of majority exceeds 18, Participants must have reached the age of majority, or must have obtained documented consent from a parent or legal guardian prior to entry.

2.2 Geographic Restrictions

The Contest is open worldwide except where prohibited or restricted by local law, including but not limited to:

• Jurisdictions subject to comprehensive international trade sanctions (e.g., Cuba, Iran, North Korea, Syria, the Crimea, Donetsk, and Luhansk regions) where prize delivery is prohibited;

• Any country where this type of promotion requires prior government approval that has not been obtained such as Italy;

• The province of Quebec, Canada, where skill-based online contests are governed by the Act respecting lotteries, publicity contests and amusement machines — residents of Quebec may participate only if the Contest independently complies with applicable provincial rules. It is the Participant’s responsibility to verify eligibility under local law.

2.3 Exclusions

The following persons are not eligible:

• Employees, officers, directors, agents, and contractors of Nine Dots Studio and its parent, subsidiary, and affiliated companies;

• Immediate family members (spouse, parent, child, sibling, or domestic partner) of the above;

• Any person who has previously been disqualified from a Nine Dots Studio promotion.

2.4 Platform Compliance

Participants must, at the time of entry, hold valid accounts in good standing on each Platform they use to submit an Entry, and must comply with those Platforms’ respective Terms of Service and Community Guidelines.

3. CONTEST PERIOD

The Entry Period opens at 00:00 Coordinated Universal Time (UTC) on 26 May 2025 and closes at 23:59 UTC on 22 June 2025. Entries received outside the Entry Period will not be considered. The Organiser’s computer clock is the official timekeeping device for the Contest.

Winners will be selected and notified on or around 30 June 2025 (“Selection Date”). The Organiser reserves the right to extend the Entry Period or Selection Date for operational reasons, with advance notice published on the Organiser’s official channels.

4. HOW TO ENTER

4.1 Entry Methods

To be eligible, a Participant must submit at least one (1) qualifying Entry via one of the following methods during the Entry Period:

(a) TikTok, YouTube, or Instagram (Video Entry)

• Publish an original video relating to the Participant’s journey or experience within the Outward 2 Beta;

• Include the hashtag #exploreaurai in the post caption or description;

• Follow Nine Dots Studio’s official account on the relevant Platform;

• Tag Nine Dots Studio’s official account in the content; and

• Tag one (1) friend (i.e., another user of that Platform) whom the Participant would like to play Outward 2 with, in the post caption or directly on the content.

(b) Discord (Video or Screenshot Entry)

• Post an original video or screenshot relating to the Participant’s Outward 2 Beta experience in Nine Dots Studio’s dedicated #exploreaurai Discord channel;

• Be a member of Nine Dots Studio’s official Discord server at the time of submission.

4.2 Multi-Platform Submission

A Participant may submit the same or different content across multiple Platforms to increase their overall chances of winning. However:

• The same piece of content cannot win on more than one (1) Platform;

• A Participant may only win once in total across all Platforms, regardless of the number of Entries submitted;

• Each Entry is evaluated independently per Platform for selection purposes.

4.3 No Purchase Necessary

No purchase or payment of any kind is required to enter or win. A purchase will not increase a Participant’s chances of winning.

4.4 Entry Limits

There is no limit on the number of individual Entries a Participant may submit; however, multiple Entries consisting of substantially identical content on the same Platform may be disqualified at the Organiser’s sole discretion.

5. ENTRY CONTENT REQUIREMENTS & RESTRICTIONS

5.1 Ownership & Originality

By submitting an Entry, the Participant represents and warrants that:

• The Entry is the Participant’s own original work and does not infringe any third-party intellectual property rights, including copyright, trademark, privacy, or publicity rights;

• The Participant has full authority to grant the licence set out in Section 5.3;

• The Entry has not been previously published or submitted in another promotion;

• Any individual appearing or audible in the Entry has given their informed consent to appear.

5.2 Prohibited Content

Entries must not contain:

• Content that is unlawful, defamatory, obscene, pornographic, sexually explicit, threatening, harassing, hateful, discriminatory, or otherwise objectionable;

• Content that promotes illegal activity, violence, or self-harm;

• Personal data of any third party without verifiable consent (including full names, addresses, or contact details);

• Unauthorised third-party trademarks, logos, or copyrighted material beyond what is permitted by fair use / fair dealing;

• AI-generated imagery or video that misrepresents actual gameplay (use of AI editing tools for minor enhancements is permitted provided the content is not misleading);

• Spam, unsolicited advertising, or promotional content for third-party products.

5.3 Licence Grant

By submitting an Entry, each Participant grants Nine Dots Studio a non-exclusive, royalty-free, worldwide, sublicensable, and transferable licence to use, reproduce, distribute, display, publish, and create derivative works of the Entry for any purpose related to the promotion, marketing, and distribution of Outward 2 and Nine Dots Studio’s products, for the duration of applicable copyright, unless the Participant withdraws consent in writing. This licence does not transfer ownership of the Entry.

5.4 Moral Rights Waiver

To the extent permitted by law, Participants waive any moral rights in their Entry in connection with the Organiser’s use as described in Section 5.3.

6. PRIZES

6.1 Prize Description

A total of eighty (80) PC Steam keys for Outward 2 will be awarded, distributed as follows:

1. Ten (10) Winners on TikTok — each Winner receives two (2) Steam keys

2. Ten (10) Winners on YouTube — each Winner receives two (2) Steam keys

3. Ten (10) Winners on Instagram — each Winner receives two (2) Steam keys

4. Ten (10) Winners on Discord — each Winner receives two (2) Steam keys

Total Prize Pool: 40 Winners × 2 keys = 80 Steam keys.

6.2 Prize Details

Each Prize consists of two (2) PC Steam keys providing early access to Outward 2 ahead of its general public release. Steam keys are redeemable via Valve Corporation’s Steam platform (subject to Steam’s Terms of Service). The Prize has no cash equivalent and is non-transferable, except that one of the two keys is intended to be gifted by the Winner to a friend of their choosing.

6.3 Prize Limitations

The Prize does not include:

• Hardware, internet access, or any equipment required to run the game;

• Any in-game purchases, downloadable content, or expansions released separately;

• Any tax obligations arising from receipt of the Prize (see Section 9).

6.4 No Cash Alternative

No cash or non-cash alternative to the Prize will be offered. The Organiser reserves the right to substitute the Prize for one of equal or greater value if the stated Prize becomes unavailable due to circumstances beyond the Organiser’s reasonable control.

7. WINNER SELECTION & NOTIFICATION

7.1 Selection Process

Winners will be selected by Nine Dots Studio on or around the Selection Date (30 June 2025). Selection is based on the judges’ subjective assessment of Entry quality, creativity, and alignment with the spirit of the #exploreaurai campaign. The judging criteria include, without limitation:

• Creativity and originality of the content;

• Quality of storytelling or visual presentation;

• Authentic representation of the Outward 2 Beta experience;

• Community spirit and engagement value.

The decision of Nine Dots Studio is final and binding in all respects. No correspondence will be entered into regarding judging decisions.

7.2 Notification

Potential Winners will be notified via the Platform through which their winning Entry was submitted (e.g., direct message or mention), within five (5) business days of the Selection Date. Potential Winners must respond and confirm acceptance within seven (7) calendar days of notification. Failure to respond within this period will result in forfeiture of the Prize, and the Organiser may select an alternate Winner.

7.3 Verification

Winners may be required to provide proof of identity, age, and/or residency before Prizes are awarded. The Organiser reserves the right to disqualify any Winner who cannot satisfactorily verify their eligibility.

7.4 Prize Delivery

Steam keys will be delivered electronically to verified Winners within fourteen (14) calendar days of eligibility confirmation. The Organiser is not responsible for keys lost, stolen, or rendered invalid after delivery.

8. DISQUALIFICATION

The Organiser reserves the right to disqualify any Participant or Winner, at any time, who:

• Provides false, misleading, or fraudulent information;

• Submits an Entry that violates Section 5.2;

• Attempts to gain an unfair advantage through the use of bots, scripts, automated entry mechanisms, or other fraudulent means;

• Tampers with, or attempts to tamper with, the Contest, the Organiser’s systems, or other Participants’ Entries;

• Violates any Platform’s Terms of Service in connection with their Entry;

• Acts in a manner the Organiser reasonably considers to be abusive, offensive, or harmful to the Contest, the Organiser, or other Participants.

9. TAXES AND LEGAL COMPLIANCE

Winners are solely responsible for any and all taxes, duties, customs charges, or other fiscal obligations arising from receipt of the Prize in their jurisdiction. The Organiser will not withhold or remit taxes on behalf of Winners. Winners in certain jurisdictions may be required to complete tax forms prior to Prize delivery.

This Contest is void where prohibited by law. It is each Participant’s responsibility to ensure their participation complies with all applicable local, national, and international laws and regulations.

10. DATA PROTECTION & PRIVACY

10.1 Data Collected

In operating this Contest, the Organiser may process the following personal data: Platform username, publicly available profile information, Entry content, contact information provided during Winner verification, and IP address or region (where applicable).

10.2 Purpose & Legal Basis

Personal data is processed for the purpose of administering the Contest, selecting and notifying Winners, preventing fraud, and complying with legal obligations. The legal basis for processing is the performance of the Contest contract (participation), compliance with legal obligations, and, for marketing-related uses of Entries, the Participant’s consent (via the licence grant in Section 5.3).

10.3 Data Sharing

Personal data will not be sold or rented to third parties. Data may be shared with service providers acting as data processors on behalf of the Organiser (e.g., key distribution services) and as required by law.

10.4 Retention

Personal data will be retained for as long as necessary to administer the Contest and fulfil any legal obligations, and no longer than three (3) years after the Contest end date, unless a longer period is required by law.

10.5 Rights of Data Subjects

Participants resident in the European Economic Area (EEA), United Kingdom, Canada, California, and other jurisdictions with applicable data protection legislation have rights including access, rectification, erasure, restriction, portability, and the right to object to processing. To exercise these rights, Participants should contact Nine Dots Studio via their official community channels. EEA and UK residents also have the right to lodge a complaint with their applicable supervisory authority.

10.6 International Transfers

Personal data may be transferred to and processed in countries outside the Participant’s country of residence, including countries that may not provide the same level of data protection. Where required, the Organiser will implement appropriate safeguards (such as Standard Contractual Clauses under the GDPR) to protect such transfers.

10.7 Platform Data

The Platforms process Participants’ personal data independently pursuant to their own privacy policies. Nine Dots Studio is not responsible for the Platforms’ data processing activities.

11. INTELLECTUAL PROPERTY

All rights in Outward 2 and the #exploreaurai campaign materials, including trademarks, logos, and copyrighted content, remain the exclusive property of Nine Dots Studio and/or its licensors. Nothing in these Terms grants Participants any rights in or to the Organiser’s intellectual property beyond what is strictly necessary to participate in the Contest.

Participants may use game footage from Outward 2 in their Entries pursuant to Nine Dots Studio’s Game Content Policy. Participants remain responsible for ensuring their Entries do not infringe any third-party intellectual property rights.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law:

• The Organiser, its affiliates, officers, employees, and agents shall not be liable for any loss, damage, injury, or disappointment suffered by any Participant or Winner in connection with this Contest, including losses arising from any technical failures, errors, omissions, or interruptions of service;

• The Organiser is not responsible for Entries that are lost, late, incomplete, illegible, damaged, corrupted, or misdirected due to computer, network, telephone, hardware, software, or other technical problems;

• Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

Participants enter the Contest at their own risk. The Organiser makes no warranty as to the value, fitness for purpose, or availability of Steam or the Prize at any particular time.

13. GENERAL CONDITIONS

13.1 Right to Modify or Cancel

The Organiser reserves the right, at its sole discretion, to modify, suspend, or terminate the Contest at any time if circumstances beyond its reasonable control require it to do so, or if the integrity of the Contest is compromised. Notice will be provided via the Organiser’s official channels.

13.2 Publicity

By accepting a Prize, Winners grant the Organiser permission to use their username and winning Entry for publicity purposes related to the Contest and Outward 2, without additional compensation, unless prohibited by law.

13.3 Language

These Terms are issued in English. In the event of any conflict or inconsistency between an English version and a translated version, the English version shall prevail to the extent permitted by applicable law.

13.4 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or severed if modification is not possible, without affecting the validity of the remaining provisions.

13.5 Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Nine Dots Studio is incorporated, without regard to conflict of law principles. Any dispute arising in connection with the Contest that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, save that Participants who are consumers retain any mandatory rights they have under the laws of their country of habitual residence.

13.6 Entire Agreement

These Terms constitute the entire agreement between the Organiser and Participants with respect to this Contest and supersede all prior or contemporaneous communications relating to the Contest.

2. ADMISSIBILITÉ

2.1 Âge et capacité Le Concours est ouvert aux individus âgés d'au moins dix-huit (18) ans au moment de la participation, ou de l'âge minimum plus élevé requis par la loi applicable dans leur pays de résidence. 2.2 Restrictions géographiques Le Concours est ouvert dans le monde entier, sauf là où il est interdit ou restreint par la loi locale, notamment :

• Les juridictions soumises à des sanctions commerciales internationales complètes (p. ex., Cuba, Iran, Corée du Nord, Syrie, les régions de Crimée, Donetsk et Louhansk) où la livraison de prix est interdite ;
• Tout pays où ce type de promotion nécessite une approbation gouvernementale préalable qui n'a pas été obtenue, comme l'Italie ;
• La province de Québec, Canada, où les concours en ligne basés sur les compétences sont régis par la Loi sur les loteries, les concours publicitaires et les appareils d'amusement — les résidents du Québec peuvent participer uniquement si le Concours est conforme aux règles provinciales applicables. Il est de la responsabilité du Participant de vérifier son admissibilité en vertu de la loi locale.

2.3 Exclusions Les personnes suivantes ne sont pas admissibles :

• Les employés, dirigeants, administrateurs, agents et sous-traitants de Nine Dots Studio et de ses sociétés mères, filiales et affiliées ;
• Les membres de la famille immédiate (conjoint, parent, enfant, frère ou sœur, ou partenaire domestique) des personnes susmentionnées ;
• Toute personne ayant été précédemment disqualifiée d'une promotion de Nine Dots Studio.

2.4 Conformité aux plateformes Les Participants doivent, au moment de leur participation, détenir des comptes valides et en règle sur chaque Plateforme qu'ils utilisent pour soumettre une participation, et doivent se conformer aux Conditions d'utilisation et aux Règles communautaires respectives de ces Plateformes.

3. PÉRIODE DU CONCOURS

La Période de participation s'ouvre à 00 h 00 Temps Universel Coordonné (UTC) le 26 mai 2025 et se ferme à 23 h 59 UTC le 22 juin 2025. Les participations reçues en dehors de la Période de participation ne seront pas prises en compte. L'horloge informatique de l'Organisateur est le dispositif officiel de mesure du temps pour le Concours.

Les Gagnants seront sélectionnés et notifiés aux alentours du 30 juin 2025 (« Date de sélection »). L'Organisateur se réserve le droit de prolonger la Période de participation ou la Date de sélection pour des raisons opérationnelles, avec préavis publié sur les canaux officiels de l'Organisateur.

4. COMMENT PARTICIPER

4.1 Méthodes de participation Pour être admissible, un Participant doit soumettre au moins une (1) participation admissible via l'une des méthodes suivantes pendant la Période de participation :

(a) TikTok, YouTube ou Instagram (participation vidéo)

• Publier une vidéo originale relative au parcours ou à l'expérience du Participant dans la Beta d'Outward 2 ;
• Inclure le mot-clic #exploreaurai dans la légende ou la description de la publication ;
• Suivre le compte officiel de Nine Dots Studio sur la Plateforme concernée ;
• Identifier le compte officiel de Nine Dots Studio dans le contenu ; et
• Identifier un (1) ami (c'est-à-dire un autre utilisateur de cette Plateforme) avec lequel le Participant souhaiterait jouer à Outward 2, dans la légende de la publication ou directement sur le contenu.

(b) Discord (participation vidéo ou capture d'écran)

• Publier une vidéo originale ou une capture d'écran relative à l'expérience du Participant dans la Beta d'Outward 2 dans le canal Discord dédié #exploreaurai de Nine Dots Studio ;
• Être membre du serveur Discord officiel de Nine Dots Studio au moment de la soumission.

4.2 Soumission sur plusieurs plateformes Un Participant peut soumettre le même contenu ou des contenus différents sur plusieurs Plateformes pour augmenter ses chances globales de gagner. Cependant :

• Le même contenu ne peut pas remporter le prix sur plus d'une (1) Plateforme ;
• Un Participant ne peut gagner qu'une seule fois au total sur toutes les Plateformes, quel que soit le nombre de participations soumises ;
• Chaque participation est évaluée indépendamment par Plateforme à des fins de sélection.

4.3 Aucun achat nécessaire Aucun achat ou paiement d'aucune sorte n'est requis pour participer ou gagner. Un achat n'augmentera pas les chances de gagner d'un Participant.

4.4 Limites de participation Il n'y a pas de limite au nombre de participations individuelles qu'un Participant peut soumettre ; cependant, les participations multiples consistant en un contenu sensiblement identique sur la même Plateforme pourront être disqualifiées à la seule discrétion de l'Organisateur.

5. EXIGENCES ET RESTRICTIONS RELATIVES AU CONTENU DES PARTICIPATIONS

5.1 Propriété et originalité En soumettant une participation, le Participant déclare et garantit que :

• La participation est une œuvre originale du Participant et ne porte pas atteinte aux droits de propriété intellectuelle de tiers, notamment les droits d'auteur, les marques de commerce, la vie privée ou les droits à l'image ;
• Le Participant dispose de la pleine autorité pour accorder la licence prévue à l'article 5.3 ;
• La participation n'a pas été préalablement publiée ou soumise dans le cadre d'une autre promotion ;
• Toute personne apparaissant ou audible dans la participation a donné son consentement éclairé à y figurer.

5.2 Contenu interdit Les participations ne doivent pas contenir :

• Du contenu illégal, diffamatoire, obscène, pornographique, sexuellement explicite, menaçant, harcelant, haineux, discriminatoire ou autrement répréhensible ;
• Du contenu faisant la promotion d'activités illégales, de la violence ou de l'automutilation ;
• Des données personnelles de tiers sans consentement vérifiable (y compris les noms complets, adresses ou coordonnées) ;
• Des marques de commerce, logos ou matériels protégés par des droits d'auteur de tiers non autorisés, au-delà de ce qui est permis par le fair use / l'usage loyal ;
• Des images ou vidéos générées par intelligence artificielle donnant une fausse représentation du jeu réel (l'utilisation d'outils d'édition IA pour des améliorations mineures est permise à condition que le contenu ne soit pas trompeur) ;
• Du spam, de la publicité non sollicitée ou du contenu promotionnel pour des produits tiers.

5.3 Concession de licence En soumettant une participation, chaque Participant accorde à Nine Dots Studio une licence non exclusive, libre de redevances, mondiale, sous-licenciable et cessible pour utiliser, reproduire, distribuer, afficher, publier et créer des œuvres dérivées de la participation à toute fin liée à la promotion, au marketing et à la distribution d'Outward 2 et des produits de Nine Dots Studio, pour la durée du droit d'auteur applicable, sauf si le Participant retire son consentement par écrit. Cette licence ne transfère pas la propriété de la participation.

5.4 Renonciation aux droits moraux Dans la mesure permise par la loi, les Participants renoncent à tout droit moral sur leur participation en lien avec l'utilisation par l'Organisateur telle que décrite à l'article 5.3.

6. PRIX

6.1 Description des prix Un total de quatre-vingts (80) clés Steam PC pour Outward 2 seront attribuées, distribuées comme suit :

1. Dix (10) Gagnants sur TikTok — chaque Gagnant reçoit deux (2) clés Steam
2. Dix (10) Gagnants sur YouTube — chaque Gagnant reçoit deux (2) clés Steam
3. Dix (10) Gagnants sur Instagram — chaque Gagnant reçoit deux (2) clés Steam
4. Dix (10) Gagnants sur Discord — chaque Gagnant reçoit deux (2) clés Steam

Total du bassin de prix : 40 Gagnants × 2 clés = 80 clés Steam.

6.2 Détails des prix Chaque Prix consiste en deux (2) clés Steam PC donnant accès anticipé à Outward 2 avant sa sortie générale. Les clés Steam sont échangeables via la plateforme Steam de Valve Corporation (sous réserve des Conditions d'utilisation de Steam). Le Prix n'a pas d'équivalent en espèces et est non transférable, à l'exception d'une des deux clés qui est destinée à être offerte par le Gagnant à un ami de son choix.

6.3 Limitations des prix Le Prix ne comprend pas :

• Le matériel informatique, l'accès Internet ou tout équipement nécessaire pour faire fonctionner le jeu ;
• Tout achat en jeu, contenu téléchargeable ou extension publiés séparément ;
• Toute obligation fiscale découlant de la réception du Prix (voir article 9).

6.4 Pas d'alternative en espèces Aucune alternative en espèces ou en nature au Prix ne sera proposée. L'Organisateur se réserve le droit de substituer le Prix par un prix de valeur égale ou supérieure si le Prix indiqué devient indisponible en raison de circonstances indépendantes de la volonté raisonnable de l'Organisateur.

7. SÉLECTION ET NOTIFICATION DES GAGNANTS

7.1 Processus de sélection Les Gagnants seront sélectionnés par Nine Dots Studio aux alentours de la Date de sélection (30 juin 2025). La sélection est basée sur l'évaluation subjective des juges quant à la qualité, la créativité et l'adéquation de la participation avec l'esprit de la campagne #exploreaurai. Les critères de jugement comprennent, sans s'y limiter :

• La créativité et l'originalité du contenu ;
• La qualité de la narration ou de la présentation visuelle ;
• La représentation authentique de l'expérience de la Beta d'Outward 2 ;
• L'esprit communautaire et la valeur d'engagement.

La décision de Nine Dots Studio est définitive et contraignante à tous égards. Aucune correspondance ne sera engagée concernant les décisions du jury.

7.2 Notification Les Gagnants potentiels seront notifiés via la Plateforme par laquelle leur participation gagnante a été soumise (p. ex., message direct ou mention), dans les cinq (5) jours ouvrables suivant la Date de sélection. Les Gagnants potentiels doivent répondre et confirmer leur acceptation dans les sept (7) jours civils suivant la notification. Le défaut de répondre dans ce délai entraînera la perte du Prix, et l'Organisateur pourra sélectionner un Gagnant de remplacement.

7.3 Vérification Les Gagnants pourront être tenus de fournir une preuve d'identité, d'âge et/ou de résidence avant que les Prix ne soient attribués. L'Organisateur se réserve le droit de disqualifier tout Gagnant qui ne peut pas vérifier son admissibilité de manière satisfaisante.

7.4 Livraison des prix Les clés Steam seront livrées électroniquement aux Gagnants vérifiés dans les quatorze (14) jours civils suivant la confirmation de l'admissibilité. L'Organisateur n'est pas responsable des clés perdues, volées ou rendues invalides après la livraison.

8. DISQUALIFICATION

L'Organisateur se réserve le droit de disqualifier tout Participant ou Gagnant, à tout moment, qui :

• Fournit des informations fausses, trompeuses ou frauduleuses ;
• Soumet une participation qui enfreint l'article 5.2 ;
• Tente d'obtenir un avantage injuste par l'utilisation de robots, scripts, mécanismes de participation automatisés ou autres moyens frauduleux ;
• Tente de manipuler le Concours, les systèmes de l'Organisateur ou les participations d'autres Participants ;
• Enfreint les Conditions d'utilisation d'une Plateforme en lien avec sa participation ;
• Agit d'une manière que l'Organisateur considère raisonnablement comme abusive, offensante ou nuisible au Concours, à l'Organisateur ou aux autres Participants.

9. TAXES ET CONFORMITÉ LÉGALE

Les Gagnants sont seuls responsables de toutes les taxes, droits, frais de douane ou autres obligations fiscales découlant de la réception du Prix dans leur juridiction. L'Organisateur ne retiendra ni ne versera des impôts au nom des Gagnants. Les Gagnants dans certaines juridictions pourraient être tenus de remplir des formulaires fiscaux avant la livraison du Prix.

Ce Concours est nul là où il est interdit par la loi. Il est de la responsabilité de chaque Participant de s'assurer que sa participation est conforme à toutes les lois et réglementations locales, nationales et internationales applicables.

10. PROTECTION DES DONNÉES ET CONFIDENTIALITÉ

10.1 Données collectées Dans le cadre de l'administration de ce Concours, l'Organisateur peut traiter les données personnelles suivantes : nom d'utilisateur de la Plateforme, informations de profil accessibles au public, contenu de la participation, coordonnées fournies lors de la vérification des Gagnants, et adresse IP ou région (le cas échéant).

10.2 Finalité et base juridique Les données personnelles sont traitées aux fins d'administration du Concours, de sélection et de notification des Gagnants, de prévention de la fraude et de respect des obligations légales. La base juridique du traitement est l'exécution du contrat de Concours (participation), le respect des obligations légales et, pour les utilisations des participations à des fins marketing, le consentement du Participant (via la concession de licence à l'article 5.3).

10.3 Partage des données Les données personnelles ne seront pas vendues ni louées à des tiers. Les données peuvent être partagées avec des prestataires de services agissant en tant que sous-traitants au nom de l'Organisateur (p. ex., services de distribution de clés) et dans les cas requis par la loi.

10.4 Conservation Les données personnelles seront conservées aussi longtemps que nécessaire pour administrer le Concours et remplir toute obligation légale, et au maximum trois (3) ans après la date de fin du Concours, sauf si une période plus longue est requise par la loi.

10.5 Droits des personnes concernées Les Participants résidant dans l'Espace économique européen (EEE), au Royaume-Uni, au Canada, en Californie et dans d'autres juridictions dotées d'une législation applicable en matière de protection des données disposent de droits comprenant l'accès, la rectification, l'effacement, la limitation, la portabilité et le droit de s'opposer au traitement. Pour exercer ces droits, les Participants doivent contacter Nine Dots Studio via ses canaux communautaires officiels. Les résidents de l'EEE et du Royaume-Uni ont également le droit de déposer une plainte auprès de leur autorité de contrôle compétente.

10.6 Transferts internationaux Les données personnelles peuvent être transférées vers des pays extérieurs au pays de résidence du Participant et y être traitées, y compris des pays pouvant ne pas offrir le même niveau de protection des données. Lorsque requis, l'Organisateur mettra en place des garanties appropriées (telles que les Clauses Contractuelles Types en vertu du RGPD) pour protéger ces transferts.

10.7 Données des plateformes Les Plateformes traitent les données personnelles des Participants de manière indépendante conformément à leurs propres politiques de confidentialité. Nine Dots Studio n'est pas responsable des activités de traitement des données des Plateformes.

11. PROPRIÉTÉ INTELLECTUELLE

Tous les droits sur Outward 2 et les supports de la campagne #exploreaurai, y compris les marques de commerce, logos et contenus protégés par des droits d'auteur, demeurent la propriété exclusive de Nine Dots Studio et/ou de ses concédants de licence. Rien dans ces Conditions ne confère aux Participants des droits sur la propriété intellectuelle de l'Organisateur au-delà de ce qui est strictement nécessaire pour participer au Concours.

Les Participants peuvent utiliser des images du jeu Outward 2 dans leurs participations conformément à la Politique de contenu de jeu de Nine Dots Studio. Les Participants demeurent responsables de s'assurer que leurs participations ne portent pas atteinte aux droits de propriété intellectuelle de tiers.

12. LIMITATION DE RESPONSABILITÉ

Dans toute la mesure permise par la loi applicable :

• L'Organisateur, ses affiliés, dirigeants, employés et agents ne sauraient être tenus responsables de toute perte, dommage, blessure ou déception subis par tout Participant ou Gagnant en lien avec ce Concours, y compris les pertes découlant de tout dysfonctionnement technique, erreur, omission ou interruption de service ;
• L'Organisateur n'est pas responsable des participations perdues, tardives, incomplètes, illisibles, endommagées, corrompues ou mal acheminées en raison de problèmes informatiques, réseau, téléphoniques, matériels, logiciels ou autres problèmes techniques ;
• Aucune disposition de ces Conditions ne limite la responsabilité en cas de décès ou de préjudice corporel causé par négligence, fraude ou représentation frauduleuse, ou toute autre responsabilité qui ne peut être exclue ou limitée par la loi.

Les Participants participent au Concours à leurs propres risques. L'Organisateur ne fait aucune garantie quant à la valeur, l'adéquation à l'usage ou la disponibilité de Steam ou du Prix à un moment donné.

13. CONDITIONS GÉNÉRALES

13.1 Droit de modification ou d'annulation L'Organisateur se réserve le droit, à sa seule discrétion, de modifier, suspendre ou mettre fin au Concours à tout moment si des circonstances indépendantes de sa volonté raisonnable l'exigent, ou si l'intégrité du Concours est compromise. Un préavis sera fourni via les canaux officiels de l'Organisateur.

13.2 Publicité En acceptant un Prix, les Gagnants accordent à l'Organisateur la permission d'utiliser leur nom d'utilisateur et leur participation gagnante à des fins de publicité liées au Concours et à Outward 2, sans compensation supplémentaire, sauf interdiction légale.

13.3 Langue Ces Conditions sont rédigées en anglais. En cas de conflit ou d'incohérence entre la version anglaise et une version traduite, la version anglaise prévaudra dans la mesure permise par la loi applicable.

13.4 Divisibilité Si une disposition de ces Conditions est jugée invalide, illégale ou inapplicable, cette disposition sera modifiée dans la mesure minimale nécessaire pour la rendre valide et applicable, ou supprimée si la modification n'est pas possible, sans affecter la validité des dispositions restantes.

13.5 Droit applicable et résolution des litiges Ces Conditions sont régies et interprétées conformément aux lois de la juridiction dans laquelle Nine Dots Studio est constituée en société, sans égard aux principes de conflit de lois. Tout litige survenant en lien avec le Concours qui ne peut être résolu à l'amiable sera soumis à la juridiction exclusive des tribunaux de cette juridiction, sous réserve que les Participants qui sont des consommateurs conservent tout droit impératif dont ils disposent en vertu des lois de leur pays de résidence habituelle.

13.6 Intégralité de l'accord Ces Conditions constituent l'intégralité de l'accord entre l'Organisateur et les Participants concernant ce Concours et remplacent toutes les communications antérieures ou contemporaines relatives au Concours.
